Artists and musicians' digital productions such as sound, images or text are no longer automatically protected from data mining.

To secure rights to their own material, the Danish Artist Association recommends that all members actively protect the content themselves. This can be done by using a standard text that is placed on pages with music, videos, photos, texts or other copyrighted material.

An active no-thank you to data harvesting
Denmark has just implemented an EU directive that has led to a number of changes in copyright law. These include so-called "text and data mining", which is used in the process of "harvesting" material on the web in order to train artificial intelligence to create new material.
According to the new rules, this harvesting can now be done without obtaining permission from the original copyright holders of the material.
However, as a rights holder, you have the option to "opt out" of commercial text and data mining by actively declining to be used. If you have made a written opt-out on your website, text and data mining can only be legally used on the page in question if an agreement has been made with the rights holders.

Recommendation: Insert text to protect your content
The Danish Artist Association therefore recommends its members to add a disclaimer against text and data mining on their own websites, blogs, media, channels, etc. where they have music, videos, photos, texts or other copyrighted material:

"Music, sound, images, texts and other content on this website are protected by copyright law. All rights to the content are reserved, including the right to utilise the content for the purpose of text and data mining, cf. section 11 b of the Danish Copyright Act and Article 4 of the DSM Directive."

 

To be effective, the text must be placed in a machine-readable way in metadata and in the terms and conditions of use of the website or service.
